Hello, Ginnu.

I have applied my GC 6 months froM vsc, can i use ac-21?
All my applications I-140,485,ead,ap are pending.

What do you suggest me.

AC 21 Regulation Release Imminent

The USCIS disclosed here in Salt Lake City that this long awaited regulation will be released real soon. It also appears that the regulation may look at the I-140 portability issue slightly different from the recent Yates' memo. Please hold your breath on this issue.

** if the I-140 is not approved I will wait till I-140 gets approved and then change the employer. dont take the risk at this time

---------------------------------- as your case EB3(India) PD is May 2004, your I-485 is not going to be touched, wait for the visa bulletin for october 2005. If I am in your situation I will stick with the employer and will wait for I-140 to be approved.
