AC-21 between branches

Can AC-21 be used between branch offices of the same company?

Let's say the LC was filed and approved for a branch in Kansas. After 180 days of filing I-140/I-485 and I-140 approval, can the applicant take up a position in the Baltimore branch of the same company?

----- if LC was filed by same company and I-140 was also filed by the same company(I-485 is your petition) you can join the same company branch and no need to use AC21.
** If you are still on H1 status and maintain H1 status then your employer may need new LCA for Baltimore from DOL and can get in 2-3 days

What if kanses branch filed for labor not the corp office. If he wants to move to baltimore, does he needs to use AC21 or not. I am in the same situation here. My atlanta office did all the paper work for me(labor and 140) but the corp office is in Dallas, tx. They never done any paper work for me. I moved to Detroit office but the same company, same job. Do i need to use AC21 or not? or I can claim that it's all the same company. Please explain.. I am confused...thanks. I am not in H1 but i am using EAD (245i filed)

---- NO AC21 is not needed as your employer remain the same

I 2nd that

No AC21 needed.

My case was approved based on a Labor ( substitute ) from a state that I don't work in. But it was for the same company. I was not an AC21 case so it doesn't matter if you move to different branches within the same organization.

GC is future job- transient branch changes do not matter. At or after approval BCIS assumes (may or may not explicitly)- you will be working for the branch at the specified location. BCIS does not check if you do.
Lets say BCIS does raise an issue with branch change- you can claim relief under AC21- work for anyone anywhere. To claim AC21 you are not required to do anything at any time.
HTH:confused:
