$$$$$ AC-21 advise needed $$$$$

My 140 is approved and very soon it will be 180 days since RD of my pending 485. I would like to use AC-21 to switch jobs soon. Please answer my questions considering the above situation.

1) I had filed for getting copies of LC using FOIA but had no response from USCIS as yet. This means I don't have any idea about my job profile. A brief job description about my job is listed in my offer letter. Can I trust the same was used in my LC? If not what should I do as I simply dont want to wait for FOIA output[my 485 is stuck in the PD retorgression crap which is going on now and I hope my FOIA output will show up before I use AC-21

2) Since I've an EAD, if I do a 1099 with some company am I technically an employee of that company?[ ie. can I use AC-21 letter of any company if I do 1099 with them?]

3) The attorney of my current employer is representing me and my spouse for pending 485's. If I use AC-21 atleast initially I want to represent myself. How do I make sure that all correspondance come to me? Do I have to file the G-28 again?

the job description in your job offer letter is probably the same in labor.

I filed FOIA with VSC just because I need to check whats in my LC and also need
to get copy of approved 140. You are asking me to withdraw it, if I do so how do I get copy of LC for AC-21 and copy of approved 140?

you don't need a copy of 140 to use ac21. it is more for your records. Get FOIA through federal DOL for your labor cert. I know that in my job offer letter the duties were exactly the same which was in my labor.

yeah, i know 140 approval copy is just for my records....my 485 is already stuck in PD retrogression. do u still feel FOIA will slow it down? I still havent received receipt of FOIA. How do I cancell it? How do I file it with Federal DOL?

How to invoke AC21

I keep hearing about AC21. What am I supposed to do. Can someone take a moment to jart down a list of documents and Forms that need to be filled out.

Is AC21 a INS Form

Is this a trigger that gets invoked to yoru case automaticaly when you inform INS that you had changed employment.


What would be the requirements on the letter to INS if I were to contact INS.


Please help me get the above details.
