i've been applying from this company since 2001 and still waiting for my gc.
currently finally i applied 485 and 140 last year.
this company is abusing a lot to me as paying very low and recently changing to hourly eventhough there is tremendous amount of job as knowing my weakness.
i'm wondering how long should i wait?
is there any law firms that dealt with this kind of situation of suing the company as i'm planning to do so after i recieve my gc on hand? so they can't do to others in the future.
they are abusing in extent and they've signed my labor when approved stating to pay that amount which never paid to me.
and i know their inside weakness.....
i'm really looking into if any law firms deal with this issue so i can process from now on.

You have an EAD, right? Take advantage of AC21 use it to change jobs. You don't need a lawyer for that, and you don't need to wait to get the GC.

thank you all.
i'll try to survive another few months see what happens.
if so what would be the process for AC21.
do current company has to transfer?
how about the new company, do they've to sign too..
how about if the new company brankrupt..

mine 485 was filed on aug 2007.

would be glad to hear.

You are not alone bud, there are many companies taking advantage of our circumstances. But, if u are wanting to use Ac21, all u have to do is have ur 140 approved, make sure 485 is applied 180 before u change companies. Ur new job requirements should be same or similar to ur old requirement. You can just apply for the new job, change jobs and just have ur lawyer send a curtosey information to the immigration that u have used AC21 portability to change jobs. Then when ur case opens for 485 approval, u can get an RFE to ask u to prove that ur new job requirements are same as that of the old one. If ur new employer can prove that, you are good. But, I would not suggest moving to a company thats bankrupt. They cannot prove they can pay you the salary thats quoted in your GC application. So, your case could be rejected based on that fact. hope it helps -
hang in there
