Hi All,

You must have noticed a lot of replies to your threads by me. I have been in the USA/ Canada
for 5 years now...recently I got my green card,
in the previous 5 years my wife and I have lived thru:
1) 3 H1 transfers for me / 1 for her.
2) 2 H1 visa stamping in India.
3) Canadian landed resident permit..coming back to the USA with no change of I-94.
4) LC,I-140,I-485 and finally the green card.


I feel that if I could put in a few thoughts that all have been based on personal experiance it might help some others here out of a nightmarish situation.

So please dont feel offended if I post my views here...remember I am not a lawyer ...just one who survived past all the immigration pitfalls with the grace of God. this board has been a great soruce of comfort over the past 5 yrs and I plan to "give back to this online community".

You've been here a LONG time. I'm not sure if you were here when I first signed on as "Jim M" years ago but you certainly are one of the people that have been on this board (and the board before this one and the board before that one) for a long time.

Yes I was...

and a lot of my doubts about the grey areas of H1/I-94/ have been cleared by you ! and what I learnt from your advice and my own experiance is that : never break the INS rules and you will just be fine.
 
Congradulations on your green card, tt tt

I remember you posted before regarding filling in the last POE on the I-485 forms. You said you last entry was from Canada thereofre there was no record of legal entry. Did INS raise the question during your I-485 process? Thanks in advance.
 
Thankfully no..

and to think the amount of time I spent trying to get hold off documentation to prove that I legally entered from Canada :)..hotel / rental receipts .
My opinion is that the INS looks for gaps in the F1-H1 or H1-H1 petitions by looking at the approval notices. If all of you I-94s are overlapping then you are fine.

Although many of your posts do provide confidence and support there are many haughty and over confident, most importantly false answers among them.
With posting difficulties for the past week, I am tired of correcting your statements. Please cease from posting junk. Your advice is always valuable if your stance is supported by prior experience or INS statute...
I am not an authority on INS, but your posts are mere opinions, not advice- this is my take on your posts.
My Opinion... Nothing personal.

The idea of this board is to get people to discuss and exchange opinions and experiances. People must have a lawyer, whom they pay for his services, and merely depending on my post or yours is dangerous and foolish. A lot of times your lawyer does not have the time to answer a lot of doubts you have and so people come here to cross check. But embarking on a trip to get a visa or filing an application based on what you learn from here is not a good idea...a good idea is to make sure that what you or your lawyer has done is along the lines of what a lot of people have done as they tell you over here on these boards.
