Hello I was a student with F1 and after I graduated I had my OPT employment card and it will be expired on 7/22/2006. I got married with an US citizen an year ago and we sent out everything of our our green card application to the Chicago Office on Feb 6th. then a week later we got back a receipt from USCIS saying that they would schedule our Biometrics appointment.

I 'm so confused what if I don't get my biometric appointment by july 06, do I need to get out of this country? or What should I do to ensure that I don't need to go back my home country?

or does anyone know how long do they still need to take until I get my appointment approximately?

thank you very much everyone!

1. You will get in time the Fp/ biometrics appointment, much more before July, don't worry. You can also try by walk-in, it depends on them if they help you without an appointment.
2.Why should you be sent back? You are in pending status right now, once you filled I-485 which is OK.

My 2 cents.

thanks for the answer,
so what is my status?
I 'm really confused.

because I thought I 'm still here because I have my OPT until july 2006. So supposing If I don't have anything from uscis by july, what status will I be?

The status is called "pending AOS", which is basically overstaying your F1 Visa.
But since you're married to a USC it's going to be excused.
Problem occurs only once your case is denied. Than there's no excuse and you're facing a ban unless you can fix that denial.

ok that makes so much sense.
so after 7/22, will I still be able to work?(if I still don't get my approval of AOS at that time)

thank you very much!

In order to work you'd need to file I-765 for EAD which gives you a temporary work permit until your AOS is approved and your ready to hold the GC in your hand eventually.
