I am working (in H1B status) for a midsize manuf. company having about 100 employees in US and 400 employees in Mexico.

Now my employer planning to start a small engineering firm, and I will be the employee of the new bussiness. Initially (may be for couple of years) there will be only 3 employess in that new bussiness. Now, I am thinking of filing a RIR LC through this new company, if there will be no issue in "Ability of Pay" when we apply I-140.

As I mentioned, it is a new startup company and it will not have any tax statements, profits and other evidence required by the USCIS, when we apply I-140. However the parent (current)company will have all the required documents for ability to pay.

Now my question is, since the new bussiness is owned by the a well established company, Can we show the financial documents of my current company in lieu of new bussiness, with the logic of the new company is owned by a big company?. Will USCIS accept the financial documents of my parent company for the "ability to Pay" requirement, if we apply I-140 thro new company?

Thanks

Thanks Erics.

There is a LC already pending with SWA thro my current employer. The problem is that, there is a lot of issues in the LC requirements (education, exp, ect..). It was not well drafted by the lawyer. I fear there may be a problem arise when DOL adjusticate that LC or may be in I-140. Hence I am planning to apply a backup LC. One cannot apply two LCs thro same employer, in same state for the same position. However, since my employer is starting a new bussiness in the same state, I feel filing a new LC thro new company will not harm.

I will ask GURUs for the help on "ability to pay" issue.
