I got my I-485 based on I-360 - the VAWA act. My husband and I have not been together since 2004. I am now looking to get a divorce but he did not agree to a separation agreement. I don't want to go through the arduous court process and since NY does not have "no fault" divorce grounds, my other option is abandonment. This will end the marriage immediately.
My question is: if I agree to the abandonment grounds, will that hurt my I-485 which was based on the Battered Spouse petition? We have lived apart since June of 2004 and I received my 10-year green card in March of 2006. Any feedback you can give me will be very much appreciated! Thank you!
