A written decision has been mailed ? Can someone explain this please.

Hi

We got a query for I-140 and my attorney responded to it. When we checked AVM it says a "Written decision has been mailed" couple of weeks back. My attorney received the letter but my company CEO and the attorney are not willing to reveal the content of the letter.

Can someone explain what the content might be?

"Written decision.." means they have either sent a denial or an intent to deny notice..try and get the details from your lawyer.
 
denial because your qualifications do not match with Labor Cert quals??

"A written decision has been mailed" means an intent to deny or a denial notice. May be INS doesn\'t consider that you have the experience and qualifications required for the job as mentioned in the Labor Certificate.

Was your I-140 approved earlier and got the query during the 485 stage? Just wondering since you have posted this message in the 485 forum? Please post more details.

looks like this message has been posted in the wrong forum. It looks like an RFE for I140. What was the RFE for ?

I140 stage also checks for the ability of an Employer to pay the Employee & Tax statements of the company are checked. From what you tell me, this might have to do something with your company & not with you. That seems to be the reason why your CEO or lawyer don\'t wish to reveal the content for the wriiten explanation sent by INS.

Not sure how you can deal with this. Maybe you should write a letter stating that whatever is revealed to you by your employer will be maintaned in confidence. If not, atleast ask your employer to give you the reason verbally.

I agree with what Prakash posted. We have recieved RFE\'s for I-140 all related to employer and not regarding qualification. They check the ability and finances of the employer who is sponsoring the green card. If your employer is a small bodyshopper then it is most likely that either he has not paid his taxes completely or something related to his company finances.
