A "V" Visa Question

Hi,

I filed my wife's I-130 petition last year (In July) at Nebraska. Like many others, I and my wife are victim of this backlog thing at INS.

According to my attorney, my wife qualifies for "V" visa if her I-130 petition is not approved within 3 years.

But many immigration resources say that for V Visa approval, the immigration petition must be filed before December 21, 2000.

Please clarify!

My husband would definitely qualify for something like this. Anyone know what this "V" Visa is???
 
kiska- Simply Search on google and you will get your answer..
marooned - The current law works for Dec 31st 2000 or before like you stated. But there is a petition in the congress to modify the law...
The petition was mentioned in the sticky on one of the forums..

If your attorney gives you this kind of dum answer to the V Visa question you should first get rid of this attorney, I don't beleive he is an attorney. V Visa category requires a petition that was filed on or before dec 20 or 21, 2000 and 3 years has passed since the petition was filed. There is a bill introduced in the House of Representative to extend this date dec 20, 2000 to dec 20, 2011 and petition pending time of 6 months instead of 3 years, but it doesn't seems like this bill will be approved in the near future.
