A Unique Case of F1-H1

I have a confusing situation --

I came from India to the US on F1 in 2000. Graduated with MS in 2002 and took up a job. Since then I changed employers twice (I'm on my third H1). But I haven't had a H1 stamping done. I now have an appointment for next week in Mexico. Can I go to Mexico for stamping though this is technically not my first H1?

Also, when I first applied for an H1 transfer, despite the portability clause, I ended up waiting 5 months before I started working for the new company. Since I didn't have an income, that reflects on my W-2s and tax returns. But I was still on status. Still, do you think it will adversely affect my chances?

One last question. The attorney for the old company succeeded in losing my original I-797 before even making copies of it. So, I am taking certified photocopies of the employer copy of the I-797 along with the attorney's letter. Do you think it will suffice in convincing the consular officer?

Thank you very much for any input on my scenario. I'm pretty worried about all this.

Mine is pretty much similar to yours... Were you able to succeed in getting your Visa stamped in Mexico? Good or bad, please post your comments and experience from wherever you are :rolleyes:

My situation is...
I came to US on F1... graduated and changed to H1 through employer A... changed from employer A to B to C.
I have W2 forms and few paystubs from employer A, W2 forms and all paystubs from employer C, but neither W2 forms nor paystubs from employer B. I was with employer A for a year, employer B for about 6 months and am still with employer C for almost a year now. I have all degree documents, H1-Transfer petition from current employer and all I-797s, in place. Only thing missing is, paystubs from employer B as I was not paid.

In this situation, are there any chances of my visa getting rejected pointing out to the fact of absence of no paystubs with employer B?

What could be an optimal answer if the Visa Officer asks for paystubs/W2 forms from employer B?

Is there anyone who faced an almost similar case as that of mine?

Kovai, the visa officer didn't even look at my current employer's paystubs let alone past employers. To start with, previous employers' paystubs is not even a requirement (at least in Mexico). If the rest of your documentation is fine, and if your interaction with the officer goes fine, you should have no problem at all.
