A question regarding processing times and so forth

My I-130 (son of a perm. resident over 21) was filed in June 2002.

It was recently transferred to the California service center last month. I also upgraded the I-130 (in the middle of that, haven't received any answer yet), to son of a US citizen.
  • I-130 as son of a perm resident filed in June 2002
  • In march 2006 transferred to California Service Center
  • In april 2006 filed to upgrade it to son of a US citizen
  • USCIS shows california working on cases from Jan 2003, so presumably I will be hearing from them shortly.
  • Visa bulletin shows they are processing visa numbers from April 2001

Does the visa bulletin refer to my original application date? or the date for filing of the Visa application after approval of the I-130? So is it 5 years out that I will get a green card? or 16 months out?

When you send in the I-130, you get a receipt back from the service center. The receipt has your priority date, this is the date you look for and compare against when checking the visa bulletin.

So your priority date is probably June 2002, and the current priority dates are April 2001 for your new preference. So your wait shouldn't be long.

You should get your I-130 approval first though, but the good news is that usually when applications are transferred to CSC they get approved soon after.

Thanks, yeah, apparently with all the moving I've done and so forth, I never received the receipt. I ended up getting the receipt number off the back of the canceled check. I will order a new one. I do get updates from them online though...

When the i-130 is approved, can I then apply for the I-765 so I can work for any employer here in the US?

Order a new what?

About the I-765, the answer is no. You can only apply for that when your priority date is current and you file for AOS.

Ah, so I would have to wait until the PD is current for June 2002...fair enough, I can though file for AoS as soon as my I-130 is completed though.?

How does one order a copy of the receipt? :confused:

You can only file for AOS when your priority date is current, man. And after you do that, in order to avoid not being able to work while waiting for AOS approval, which might take anywhere from a few months to a few years, you can file I-765 to get a work permit.

There is a form for ordering a receipt...you pay a small fee, I'm afraid I don't recall off the top of my head which form it was..I-8something or other...

Hmm, I didn't realize I would have to wait until June 2002 to file for I-485...
