A question about overstaying

Hi everyone!
First I will explain my situation a little bit...
I came to the USA from Belgium about 3 years ago. I entered the USA legally, with a visa for 3 months. During that time, me and my then boyfriend decided to get married. we got married about 8 days after my visa expired.
We wanted to get started on my papers, but stuff kept happening to delay it further and further. So now I've been here for almost 3 years, and I don't have anything done yet.

I really want to get started on all this paperwork, and I will actually be seeing a lawyer for the first time tomorrow. Which is a step in the right direction :)

Now my question is, will I get in trouble for overstaying my VISA and not applying for anything for 3 years? Or will it not be a problem? Me and my husband have a daughter and I keep having these nightmares of me being deported and not being able to come back :( That won't happen right?

So long as a) your boyfriend is a US citizen; and b) you do NOT leave the US under ANY circumstances until your GC is in hand, yes, you should be fine.

Don't even bother applying for Advance Parole, and don't plan any trips.
 
Yes, my husband is a US citizen. So the 3 years that I waited are no problem?

I am not leaving the USA willingly, I know I can't do that :)
