A question about I140

Hi
I had my labor cleared and my lawyer filled my I140 on February 2003 in the EB2 category. The current processing dates for the California center says 4/9/03, which concerns me as till now I have not received any decision on my case. Do you think I should talk to the lawyer about it or call and ask about my case. Have any one applied for I140 at the same time and got reply.

i think you may be able to send a fax inquiry to bcis. talk to your
lawyer about it.

Check out the processing times...the posted times are 06/04/03 for EB2 in CSC.

I spoke to my lawyer and she says that concurrent filing takes more time and so not to worry about the dates. She says they are watching concurrent filing too close these days.

Filed 1-140 in Oct 2002 in C category with CSC:

BCIS RD=10/22/2002

My (former) Lawyer got RFE on 03/31/2003

Lawyer screwed up, had to scramble at the last minute and did not file evidence until June:

BSIS RD 06/17/2003 for evidence

So I am still waiting on a decision. Processing times for CSC says they are processing cases from 02/06/03.

I have fired lawyer because I found out, among other things, he has not filed proper evidence initially for any of our petitions. I know his screw-up has caused some of this delay but in talking to BCIS service ctr myself, they say it it way beyond their normal processing timeframe for this case type. They said they would inquire and contact me in writing in 30 days with status.

How long should this take after evidence submitted?

Does anyone have any other ideas how I can follow-up on this?

Has my lawyer's actions somehow jeopardized my case?

When I asked why stuff was taking so long, (former) lawyer used to tell me there was nothing he could do. If it was beyond their processing times, he could inquire about it but it would piss BCIS off and they would simply deny case. Is there ANY truth to this?

I am in the similar situation. I-140 filed in Sept. 2002. RFE was replied in April 2003. My lawyer filed enquiry about six weeks ago and recieved the reply from BCIS but nothing is meaningful. Basically said that your case is still pending. In this sense I guess your lawyer is partially correct.

I also called a number of times to BCIS and one stage I had chance talked to the officer one level higher than the original one who could not answer my questions. The answer was that you can file an enquiry and BCIS will reply in 30 days. As I mentioned I did receive the answer with 30 days but still waiting. It seems to me there are still some cases filed in the same time frame are still waiting.

Did you concurrently file I-485?
I am trying to see if there are any similar patterns here.

My RFE was quite extensive but I think part of that was due to my lawyer not including any evidence when I-140 originally filed. So they asked for everything imaginable it seems.

I also have L-visa renewal outstanding since Jan/03 and I hear those are only supposed to take 30-60 days.

I am worried as I see so many posts from people who have applied later and have rec'd approvals already.

Appreciate any info you can provide. Thanks!

My employment visa is L-1a.
They requested just about every possible bit of evidence and still no resonse since they rec'd RFE on 06/17/2003.

I am curious to know how it works at the INS once the evidence is rec'd. I hope we don't end up at the end of the queue again?!?

I have asked then for a status.

My I-140 was NOT concurrently filed with I-485 so I can find no other explanations for the delay other than my lawyer should have filed the evidence with the original petition to avoid the delay of the RFE.

Hi everyone,
I wanted to know 158 days that they post in the site is it working days if so I should expect a reply from them in sep as my I 140 was submitted in Feb. I dint get any RFE or approval and my lawyers says we need to wait ...any advise will be of great help
