A new pattern I noticed

On Rupnet yesterday one person got approved almost after 3 months after CIS recieved the REF docs and today one more person got approved after three months....so now I am changing my mind from 3 weeks to 3 months so I can relax and dont check my status every hour.....

It depends

I think it totally depends. Some people got approval after 3 months some like me approved after 1 week. Don't be jealous. I have been waiting for 25 months since filing 485 so I am not really the lucky one. But in a word, the range can be quite wide. Hopefully this can encourage you a little bit :)

Another thing I noticed (from the file Kanadian initiated): The LUD changes that stopped after a while in most of the cases mentioned in that file seem to be impacted by the Retrogression (most of the PDs are in 2002 and EB3). Does anyone else share this view?

Dont worry

Kanadian,

Last week one of my friend got approval in one day after receiving RFE by USCIS.
He send his response on Friday and USCIS updated their site about the recipt on Tuesday ( i.e. after 3 days) then on wednesday they approved his case.
His case is EB3 filed in Dec 2002, PD is in June 2001.
So it is all luck. Dont think that USCIS guys are consistent in any thing.

I don't share this view. There are many threads on this site that support the view that LUDs commonly change for several days after RFE receipt by USCIS, then stop, followed by approval several days to several weeks later. My wife and daughter had RFEs received by NSC on 12/28/04, and several subsequent LUD changes, similar to people in Kanadian's file. My family are not affected by the Retrogression (early PD, different country).

I dont agree, as I am from different country so retrogression doesnt apply on me.

processing

When NSC says they are processing July31 2002 cases. Is that mean cases filed on July 31 2002 or Priority Date July 31 2002. please let me know. I hear different things from different individual.

One thing i noticed is (not regarding LUD) primary is getting the approval and dependants are still waiting..
for eg, my case, SSK007, crystal_yajing ...

Hi kanadian..c this

Attorney Murthy : The USCIS has not stated if they will follow any cut-off dates in processing I-485s. We know that, previously, when the priority dates (or PDs) were backlogged, only CSC was not processing those I-485s with backlogged dates when the visa numbers were not current. The other service centers were previously processing the cases and sending out the approval letter with the note that the person could get the PP stamped when the PD became current. The USCIS has not made a policy decision on what they plan to do this time around.

my 2 cents

the response time is based on RFE's complexity mostly --- if RFE is even a bit complex - u can expect wait times to be 2 months -- for e.g of late 'm seeing 'Ability to pay', 'Employment Verification' etc decision to take roughly 6-8 weeks after response received - of course there is an exception - i think magajmari got his decision within 10 days!

So you mean if they ask for EVL, the adjudication would take approximately couple of months. I was thinking asking for EVL was a very simple RFE.

agree

I agree, with complexity, they may even transfer to the local office. In straight forward rfe like mine, there is no reason for them to holding on. I had to get a varicella vaccination knowing well that it is not going to have any impact. My doc had a laugh when he saw the USCIS letter stating that i should have though the doc felt is not required. :D

ZSUJ is right

Even i got the same kind of RFE and went to my doctor he said since your wife had chicken pox she doesnt need this shot. But it is always better to take this shot otherwise they may ask her to submit the proof of taking that shot.
So we both took that shot.
