Hello,
i just want to share my story of adjustment of status from K3.
I came here on K3 in FEB 2005 and applied for AOS after a week.
On 12/29/05, was my interview and we appeared for an interview with all docs. Interview was fine, and we were never asked about any evidences.
Officer told us that i can't give u GC as i need updated income papers of my wife, and vaccination supplement.
We sent these papers two times, one time due to mistake of doctor by checking wrong box.
after two weeks, we got a letter from District director, Notice to deny letter, due to not submitting evidences of joint life.
I sent a lot of evidences, bills, bank account, life insurance of my wife, etc.
one ,month passed now and there s no answer from USCIS or any update on my case.
Everyday of mine passes very hard. don't know what will happen?
Is it normal, can i hope better result?
Thanks

I'm not a guru, but I think I can help out a little. You seem to be in need of an infopass. Visit www.uscis.gov to schedule one. If you don't know where your evidences are, then perhaps you are sending it to the wrong place.

Also, you say that the interview went fine while the officer asked you for updated income papers of your wife and the vaccination supplement... those are "evidences" and required documents. The doctor you went to seemed to be not very experienced with this kind of things.

Good luck,

I got a problem with my vaccination report. The doctor filled up wrongly. Nobody can't know THIS part until the USCIS at the interview check that out. The doctor always is one of the list of USCIS but believe me, they should review that list...is it really not in your control. Fortunately, they let us solve the problem right away since the doctor's office was two blocks from there.

How long passed since you submitted the other documents?

One of the information that you must bring to the interview are the last tax returns and tax transcripts. It is unfortunate that you didn't find this forum before, it really have a LOT of info. Check the links at the AOS interview timeline threat-first page.

You should make an INFOPASS with all your documents (including your receipts of course) and check if there is something missing. And verify the address where you need to send the information.

Good luck,

Thx for a positive response,
Ya, i realize now that if i would be here before my interview, it would help me a lot.
However, In interview, officer called my wife and told her in the door that i can't issue ur husband a green card today, one income paper (rent from her house) lease is photocopy, i need it origional n vaccination supplement.
However, after that, we sent those papers.
After that we got this intent to deny letter, stating u havn't submitted evidences, which we never asked.
We sent those paper on 7th march and registered the package.
we got our reciept back stating, USCIS has recieved ur package.
Also, the senator office sent us a letter that they have recieved ur evidences and that u will be considerd in law.
So they have recieved all evidences. But the problem s that even after one month, i never got a response yet.
i m just depress, with all this bullshit by this office.
what this long waitmeans, they r still doubting or they r doin some kind of inquiry or what, any one has any idea?
thx

also,
my EAD is goin to expire on 2nd may, n so driving license.
i didn't apply for EAD renewal as i still don't know, what s going to happen as my all paper work s prety much done, n at the moment, i m just waiting for their decision.
any suggestion, what should i do here, apply for EAD or just wait for decision?

You should sechdule an infopass asap and see what is going on. Make sure you bring to the infopass session all that you have asked of you before in case they lost them. Go there and make sure that you have finalized everything they need to make a decision.

Also, apply for another EAD if you are working. In my opinion you can't afford working illegal. Call up the 800 number and see what they tell you. Don't just wait on them, your case might be sitting on some desk sleeping.

I have contacted my senators office numerous times and they do nothing to help me.
My EAD case went cold on the first of April and i am getting more and more impatient, it was moving nicely till that day, daily updates.
I bet the guy went on vacation, or needed the bathroom and that was the only toilet paper he could find, MY case file

u r exactly right token_ranger,
my senator was quick to respond, however, it was not too effective, just an inquiry.
n congressman's office s still working hard to solve my case ( ).
i couldn't find any job since i came to US, so i don't need for job.
USCIS don't miss any document, but they never ask about evidences. n later they asked for it in "intent to deny letter".
i explained to them in cover letter, n i wrote that we were never asked for it.
some ppl told me that don't argue with USCIS, n just elicit sympathy.
however i m so pissed off on their work that i explained everything,.
i even told them to watch interview video if u don;t know, what we were asked for. n that if u ppl r so doubtful in our relationship, give us a chance for 2nd interview to let us explain our relationship.
however, i sent a lot of papers, the wait s only now for their decision.

yeah i am worried about the GC interview too just sick of this limbo, if i could get my conditional card then me and my wife can go on and stop fretting about all this paperwork and being deported for some inane reason like saying carpark instead of parking lot.

the same s my situation.
when my interview occured, i was hoping same for conditional GC, but after four months of this sending RFEs, now i m expecting permanent GC.
WHat pissed me off in the last "intent to deny letter", they sent was the statement of the letter, saying u submitted only two evidences (one combined bank statement n that my wife has changed her life insurance beneficiary to me). I sent these papers with income papers for affidavit of support n District Director thought, these r only evidences of our shared life.
Thats why in response, i thoroughly explained the previous history to her, as i imagined she doesn't have any clue, what s going on in our case.
also, i was very angry, as i was expecting GC according to what that SOB told us in interview.
n i don't think that u can elicit USCIS's sympathy.
also, each day s like hell waiting for this dam GC.

Is not about arguing with USCIS, of course you must push and keep going and going, but is to know where you are seated and to know how is the process so you can check things in the right way and act as soon as you can. At the time of the interview it was the time to make a lot of question like, how many days I have to send this? how long that will take? can I renew my EAD?, it is in your part to be proactive as well and make questions. That is the way it is. Yes it is frustrated and takes time consuming, but keep saying that "they" tell you something when is not, let's be straight the officer by your post never told you that you was approved in the first place neither (by your post) that after submitted that evidence you will be done or what and that you was going to received a green card. At least, your case is about evidence that you had to submitt, there others waiting for FBI name check that is even not make by the USCIS which is worst since is a hot potatoe going back and forth.

I am not saying that you should not worry about of course is a feeling of like "life threating" but we know that is not, and at least you have received proper actions from your Congressmen, which the only thing s/he can do is to check what the USCIS have, not make approvals or something like that.

As we recommended you, the first move is to go with all your paperwork (including originals) and passports and even with the responds from your Congressman to your DO with an infopass and keep pushing, there is nothing wrong with that. Let us know how your INFOPASS went! hanging in there...

Cherr1980,
Ur discussion really makes sense. Looks like u know USCIS ppl far better. Yes, i realized that i should have be to the point to that SOB and should have asked these questions.
But, the reason, why i didn't ask any question about timings or EAD approval, because, before he started interviewing my wife, he told her that i couldn't issue me GC, as i need only, these two papers, "income update and vaccination supplement".
My wife and me still fighting and arguing, i tell her u didn't push that SOB to see our joint papers, n she tells me, why u didn't ask. She told me that i push him to see the papers, but everytime, SOB says, its ok, everything looks fine. He was givin us the impression, all other things r fine, but the two things r the only papers, have hold up ur case. N so thats how we got decieved.
What we do now, is to just think about interview and get crazy that why we didn't throw these joint evidences, which DO asked in last NOID.
Hell s, u can'e even contact the ppl, u r dealing with.
I can make an infopass appintment, but as i was told that u can only get general information, like in my case, ya we recieved the papers, we r workin on it. As there s no other thing left, they can ask.
