Hello!

I am new here but I have been reading and getting my questions answered. I am currently married to a French citizen. He has been here for about for 4 1/2 years on an H1B Visa. Before that he was on a J1 Visa for 10 months.

We met last summer and we fell in love pretty much from the first date. We started talking about marriage within 6 months of being together. I moved in (ok I kept my apartment) for several months before the lease was up at which point, I moved in 100 percent

Long story short, we decided to get married in April. He got fired in early April. There was some time between when he lost his job and when we got married. I don't know if he was legal or not at that time as I have never found any concrete answer on that.

So after we got married we did all the paperwork (whew) and filed it on May 24th. As of yesterday he had his FP taken.

Also, for the record, he was VERY close to getting his GC through his work but of course when he was fired, that ceased. I hated his company as they held this over his head for quite some time. I also think he was underpaid and "used" because they knew that H1B workers tend not to make a stink for fear of being fired.

I thought I would add our timeline of filing to help others here. I am so glad I found this forum as there are alot of knowledgeable people. Also, its nice to know we aren't the only stressed out couple going through this! :)

I am assuming you are an US Citizen? I am glad to see everything is workign well for you guys. After the FP appointment you should receive the Interview Letter.

I am looking at your timeline and I do not see an I-130. Surely you must have filed one?

Assuming you are a USC, it really doesn't matter whether he went out of status or not (it will be forgiven), although the fact that you got married after he lost his job may cause USCIS to probe the validity of your marriage a little more thoroughly. It shouldn't be a big deal because it sounds like you should have ample proof of living together etc.
 
let's hope his J-1 program didn't make him subject to home residency requirement. Check his visa, passport, and DS-2019 for words like "subject to 212(e)".
