a few I130 questions for experts and all

Hi all

I scanned thru this forum but couldn't find answer to this question.

My Mom( a GC holder)had filed I-130 for my brother,over 21, unmarried (cat 2B) in 2002 (priority date Aug, 2002). It has recently been approved. I know he has to wait till his date becomes current but My mom will hopefully be a US citizen soon in a couple of months. Now my questiona are

1. Can she upgrade the case?
2. If she can (from 2B to 1st), How long does it take and what is the procedure?
3. if she can, does the priority date stays the same(Aug 2002)?
4. If it stays the same, and they are processing 22April01, does that mean his date will be current in 1 year and 4 months?

Probably because you said that you get through the forum and didn't get any answer but many times this has been answered.
1. Yes.
2. Nobody knows, there are people who decided to drop the I-130 and then file again as a new one when is case of spouse. But since is a son over 21, then she must go through upgrade so he can keep his priority date.
3. Should be. I think so.
4. I haven't check out the Visa Bulletin but if that the way probably it goes then that could be more or less the timeline.
In any case, you can call the customer service number.
