A Complicated Case of US citizen staying in India

Hello all,

I was born in the US. I came back to India when I was 6 months old on my mother's passport. After coming to India I made an Indian Passport and completed my education here. Now when I became 18 I chose US citizenship and made my US passport in. We were ignorant and assumed dual citizenship is permissible hence after making my US passport I also renewed my Indian passport.

Now when I want to come to US for further studies, I am facing lot of trouble cos of my ignorant mistakes. I have visited the Home Ministry at Delhi atleast thrice cos this case as they say is an overstay of 22 years(from my entry to India in 84 till now). The procedure is strict as we have done some mistakes, grave ones. Truth is had we known the rules we wouldn't have done all this, y would we put ourselves into all this - holding 2 passports, n coupla other things. I'm really worried as to what my fate is?

Neither my parents nor I ever paid attention to all this n now we r just at the mercy of Govt. of India... If anyone know of such a case or know fate of such cases do reply..

Missing some information here

Why do you need the Indian Government's permission to leave India? Your message is missing some information: you say you chose US citizenship and I guess you have a valid US passport; what is stopping you from getting into the US? Are you worried about visiting India in the future?
 
Once you opted for US passport, your indian passport becomes invalid. You are no longer an indian citizen. You need to apply for PIO/OCI. You can apply for OCI from india itself if you are in india currently. You can ask for exit visa from india to avoid any problems, if you are in india. If you are in US, you can apply for OCI here.

N yes I do want to come back to India sometime, my family friends r here.. But more importantly I wana leave 4 US n for tht I need the Indian visa else the immigration wil question how I have been staying here?
 
What are they saying for your overstay? Are you in India or in US? If you are in India, how do Indian authorities let you over stay more? :)
They have to either let you pay the penalty and grant you a valid visa or deport you to US. I am still unclear of your situation.
 
The issue is 18 yrs ago all there was tourist visa and student visa apart from our religious visa..
now any person who enters on these visas need to register with the local cop's and keep updating every 6 months and some other bullshit..
dude,what ever it is its just a minor issue.trust me i lived in india for 22 yrs...
btw what city are u living in?

Having lived in India for such a long time, you must have heard of the term "bribe". It works. Find right channels and spend couple of lakhs and things will happen like magic.
 
ginnu - i hav shown min of home affairs my mother's pasport on which i entered.. n my US passport tht i made.. stil they say its an overstay n at 1 point they'd said i mite need 2 pay foreigner's fee for my education in college here :( This time when we wil go we'll take out ind passport canceld.. But i rly hope they dnt beat arnd education issue again..

GreenCardVirus - wel n bribe yeah i kno of it.. its just tht we havent tried it in the ministry out of fear..

A friend of mine was born in the U.S., when her father was on deputation at US many years back. That was the time when children used to be on their parents passport and separate passports were not issued to them. They left back to India when she was a few months old. She never had a US passport.

Around eight to ten years back, she got married to a guy who was coming to US on H1. They were really not sure as to what status she was to enter US. She had an Indian passport and she went to US consulate for her H4 Visa. She was issued a H4 visa and she returned home. Even before she could reach her home there was a call from US consulate that they had made a grave mistake since she was a naturalized US citizen they had issued H4 by mistake and they called her back to the consulate and took her in directly and profusely apologized for their mistake and issued a US passport.

She lived and worked here all these years and her husband also got his greencard on the basis of being married to a citizen and now they left to India at the beginning of this year.

I do not know how this will help you, but I thought I should share this with you.

thanks for sharing your friends story...but one thing which really puzzles me is one person having a 100 id's...talk of being a member from 2002 and having just 2 posts...tht is awesome...
its like i create a id today and post a query and 4 yrs from now i still remember the username and password and reply....
 
Hey....I opened this ID when my case was posted to Consular processing by INS...though we had not requested it....till such time I had never heard of consular processing....so started going thru the forum which really really helped us.

we will be applying for our citizenship by the end of this year...so going thru the forum again for all the help needed and to be prepared for the process.

I really don't understand whatz weird about this...Infact got a new password from immigration portal when I posted the last time about AR11.

just messing around...btw u must be eligible for citizenship by now,if i am not wrong...get it done asap,with all the new rules and restrictions coming out you dont want to delay your case....

Yeah this language is picked up from chat and I was in a hurry so this quick english, am kinda used to it.
