A big disappointment with my 2nd interview today !

Hi all,

Just wanted to give you all heads up on my 2nd interview at Atlanta DO today. If you recall from my previous postings, my interview never took place back in Jan of this year. Today it was nothing different but another big disappointment at Atlanta DO.

I was called for the interview around 8am this morning. The officer took me into his office and simply told me that he cannot interview as the file has not reached Atlanta DO. He told me to wait and there is nothing that can be done.

I am very depressed and down at the moment. I want to especially thank boatbod, brb2,lightrain, Hurracan and worried2007 for showing interest in my case & praying for me but I definitely like your sincere advise at this point what should I do. I am lost.

I also feel for frsutrated_alot. He & I are in the same boat.

Hope it all works out for us.

That sucks :( This is the second screw up from the CIS on your case. Id suggest you call your local senator / congress persons office and have them look into this.

I am so sorry. Have you written any letters as yet? My namecheck is actually cleared and i think that had to do with my letter to Laura Bush. My problem is they are still saying that they are doing additional checks. Also, i am a female;). I am so sorry, i sympathize and empathize with you. This is nothing but frustration for me. My husband is still in Guyana, without my citizenship it is going to be five years before he is here. I hope things work out for you. Call your Senator, Congressman. This is outrageous. They can do something they are just not doing it.:mad:
 
I am really sorry to hear this unfortunate news. In my opinion the only person(s) who can really help you on this is your senator(s). You also need to file a complaint with the USCIS Ombudsman. This is really ridiculous.

Calling Senator's office

Thanks to all of you for taking time out to provide me your suggestions and feedback. FYI, I have been in touch with senator's office since April of this year. Upon iquiry from the senator's office last week I received a letter from their office this afternoon. It was dated Oct 4th. The letter says that USCIS is still doing additional security checks. I may want to wait another 120 days before making another inquiry.

My question to all you folks is, do I stand a good chance if we go for filing a lawsuit? Please comment.

Well that just sucks. Sorry bro.

Not sure if you'll have any success with the lawsuit angle. Problem is, you only gain the benefit of the 120 day lawsuit window if you have actually had your interview. If USCIS just keeps calling you in and turning you away, there isn't much you can do under 1447(b). Maybe you could go the WOM route, but I'm no expert in lawsuits, so I really don't know for sure.

If you saw my very first posts, I had repeatedly mentioned that I suspected this sounds like a name check issue to me, and the 'file not sent' is a symptom of the root problem. I suspect your recent visit to your home country may have triggered some additional security checks. I hope none of your visits were over a month and not too frequent visits either?

I haven't read atlanta_brothers previous thread on this but did uscis or the senators office confirm if his security checks were complete? because if they were I don't know what additional security checks is USCIS doing. Also I wonder why the adjudication office didn't mention about security checks etc.

CIS Ombudsman encouraged anyone with an unusual experience regarding her/his case to submit DHS Form 7001, with specific case information
Print and send the 7001 form.

I suspect your file is missing in National record center or the National record center sent the file and it reached some other office and not Atlanta. I don’t understand if the officer did not had your file then why they called you for second time? File a complaint with CIS Ombudsman and also contact your congressman /senator office
 
Regarding my case

I read all the postings from you and seems like you all guys pretty much agree on one point and that is to contact my local senator. I got a letter from the senator's office yesterday afternoon. The letter dated Oct 14th says that my case is still pending because of additional security check. I am surprised how come USCIS doesn't tell me this. They are just making one excuse and that is....the file is not here otherwise everything looks good. The senator's office has been telling me over & over that they can't do anything to speed up the process or try to get me the interview. They can just give me the status on my case time to time. The senator's office suggested that I can check with them again may be once a month.

I don't know what should I do. Can I not stand a slight of filing a law suit. Just coz my interview never took place, I don't stand a chance at all ? Calling me twice for the interview and sending me home....what is this ? Do I not have a strong point to present this matter before the judge and have him pressure USCIS to do something about it. Am I just going to go to these interviews everytime they send me these fake interview letters. Luckily, I happen to be in town since I am in between projects. Usually I am working away from home (Atlanta) on projects nationwide. It will be a pain to travel back and forth. This has to stop, especially when my case is so straight forward.

It seems like your case got stuck inside CIS due to internal problem of some sort - lost/misrouted file, incorrectly or never updated information, or bad communication. As a result they feed your Senator with one status, and report another personally to you. Having heard of those weird things happening more often than they should, I believe that filing WOM is the most efficient way to put processing back on track.

Everybody is different, of course. Some people prefer waiting and comfortable with it. For me, for example, doing something is MUCH easier than sitting around. Consider this - that huge amount of mental energy and time you spend on this could be invested much more efficiently.

I am proud to say that off of all the postings I have read so far, you have really impressed me. What you have written is to the point and absolutely correct. I had a chance to speak to few attorneys between yesterday & today and most of the attorneys who are known to file WOM's told me the same exact thing what you have written in your postings. The file must be routed somewhere else, nobody has any idea where it's sitting & the best excuse is "Additional security check". Ridiculous.

Agreed, absolutely. And, looking forward, CIS will be busy with avalanche of new applications, then they might get worried about changes in leadership due to Presidential election, then they'll take their time to adjust to it... So digging out lost old files might not become their first priority for a looooong time.

As a bottom line, if I was in your shows, I'd file WOM now. Well, being in mine, requires to wait some more. :)

If u don't mind me asking you, what's holding you not to file WOM. Do u like to wait & give USCIS more time to clear your name check.

I also read in one of the postings that writing to Laura Bush has helped solved lot of candidates pending N-400 applications who have been waiting for months/years. What do you think ? WOM vs writing to Laura Bush ? Please comment. Thanks
 
I am confused now

Sure! I wrote to Mrs. Bush in September, haven't heard anything back yet. For WOM - my N-400 is younger than 1 year now, - not mature enough to take it to the court. :)

Please take a look at this posting from one of the registered users and comment on it. This guy seems pretty smart and looks like he knows his stuff. Are you familiar with FOIPA ? I thought I'd share it with you. Take a look at it:

You said that your name check & FP were cleared since March of this year, and there are some additional security checks going on. So, it looks like your case is somewhat different from the normal situation.

Since there are some additional security checks going on, it is better for you to know if there is something wrong for you at FBI. One suggestion is that you may want to send a FOIPA inquiry to FBI to make sure there no case at FBI against you.

If you receive the FOIPA inquiry result letter back from FBI, and the result is "No-Records", which means that there is no case at FBI against you, then you can ask USCIS/FBI why you need to go through the "additional security checks" and not give your personal interview so far.

As a matter of fact, I haven't heard of anybody who would manage to receive something other than 'no records' as a result of FBI FOIPA request. Maybe this guy's clients did? I'd be very interested to know what FBI revealed to them in it's FOIPA response: their federally investigated crimes, I guess.

Man, who are you ?.....you're awsome. You come up with such awesome and great arguments....BINGO. You have convinced me all the way. I ain't wasting another minute & going for WOM sometime next week. No more waiting and wasting time. Even if it has to do with additional security checks, whatever it is....when we file mandamus and go thru Federal Court, everything will be clear as crystal. To tell you the truth, the attorney I had consulted earlier told me that this last additional USCIS check after the name check is nothing but a quick 30 second check, that's it. USCIS is sitting on it for the last 9 months......ridiculous. I am sure you will agree with what he was saying. Thanks for all your feedback, comments and great suggestions.
