Hi

Chan you give us any additional details. Like did you change H1s? or did you have a change of status from F1/B1 to H1 etc... or are you with MS or BS+5 yrs case...

that would help in understanding the case.

Thanks

It could be a simple document thing. Or it could be a 140 redo.

Wait for the letter and keep us posted, if you don\'t mind.

I guess you can ask guys who already re-filed their 140s, and see what kind of msg they got.

Hi g32......, an Intent-to-deny, these days, is not at all unusual. I have
seen many postings where an intent-to-deny was issued. In one case,
the INS thought the petitioner as out of status for a short period
of time, so they asked him to prove that he was in status or pay a fine.
An intent-to-deny is easily responded to and I dont think you should have
any problem (other than the extra delay involved)

Wait for RFE to come then you can decide.Mean while did you changed the company after filing 485 or your co name has changed??

thank you all for the reply. I saw the letter and it says: the INS cannot find my evidence of entering U.S. legally. (Then how could I get my H1?). So either give evidence of legally entering U.S and I kept the legal status, or pay $1000 fine, or my case will be denied. A company letter is also needed.

Good thing is I did maintain a good status since I came here and I am still with the company who filed the GC process for me. Hope I will have luck this time.

I will have you posted. thanks again
