9th Year H1B & H4 Visa Stamping in Chennai - Please Help!

Hello All,

Recently my attorney has applied for my 9th year H1B & H4 extension and my 8th year extension is set to expire on June 2006. At present we are planning to visit our parents back in India, So my wife & kids are likely set to depart for India upon the receipt of I-539 approval letter. I am planning to go down there sometime in June/July visit my parents, get the visa revalidated and bring back my family with me. I just started looking into scheduling an appointment with US Consulate in Chennai via (https://www.vfs-usa.co.in/Home.aspx). What a bummer? The latest appointment available is in August 2006.

My question is.

*. Will my wife and I qualify for the emergency appointment?
*. Getting revalidated in Canada – Is that an option?
*. What are my other options?

Yes as per VFS website you qualify for emergency appointment.

Yes going to Canada is an option, go through Canada forums to read some experiences.

Unfortunately they have let us with very few options either go to your home country for stamping or go to Canada/Mexico for stamping or wait for EAD/AP and go travel.

I really appreciate you for your quick reply. Is there any wait time for emergency appointment? What is the procedure? Is there any website that you can point me too?

I did look around the Canadian forums but being 9th H1B extension stamping I didn't find, whole lot information? In some circumstance people have turned around to go back to the country origin to get there visa revalidated.

If you were in my situation, what could you do?

If I were in your situation, I would first check my schedule and see if I can go to India in August when the dates are available for appointment.
If I can go to India in Aug, I would take interview date ASAP and block my time at consulate in India.
If it is absolutely necessary to go to India in june/july then I would try for emergency appointment. Unfortunately, it is not staright forward to get emergency dates you have to keep checking back and forth on the website for emrgency dates. You can check this on the same VFS website where you checked normal processing dates, there is a link for emergency appointment at the bottom.

There are lot of people going to Canada and get stamped. If you think you have all necessary documents, you can prove you have never been out of status, you have never been arrested, you have your education evaluated without problems and don't want to wait for stamping till you are in India you can go Canada/Mexico.

There are risks involed everywhere, people are getting stamped in Canada and people are getting stucked in there home country, so nothing is guaranteed. You just have to decide what would be best for you and go with it.

So if I were you I would wait till I get dates in my home country and if its absolutely necessary to go to India, I would try Canada, ofcos you need to do more research on this, but its just my opinion.

In Jan I got stamped in Mumbai, if there is anything I can do to help, I will.

I really appreciate you for your eloquent reply. Due to some family occasion we have to be there in INDIA by 3rd week of June. So I am firmly perusing the Canada option. But being an ‘Indian Citizen’ are we eligible to get our visa revalidated in Canada or Mexico? Whereas I read an article some place stating that visas can be revalidated only from the country of Origin.

As you know my 9th year H1b & my wife’s H4 extension petition is still under process.

*. To schedule the Canada Appointment, do I need my I-797 petition?
(Valid 06/06 thru 06/07)?

If I produce my 8th year H1B extension (Valid 06/05 thru 06/06) and 9th year H1B extension (Valid 06/06 thru 06/07)?

*. Will the official validate by VISA stamping till June 2007?

Yes we are eligible for stamping in Canada and Mexico. Just look at the canada thread and you should be able to find all the information.

Yes if you take your latest (9th year) I -979 you can get stamped till expiry of that petition. You cannot get stamping without original petition. You can look at the consulate site where you are going for list of documents needed.

Hello,
I was on my 7th year extension when I went for stamping in January. There was no risk involved as far as 7th year was concerned. As long as you have all documents with you including proof of LC filed before 365 days then you should be fine. Here you will find list of documents you need to take

Plus, if you surf through some threads you will also find that there are some other documents they need like W-2, Patstubs, client letter and photos. I will try to get my list and PM to you as soon as I can.
Interview itself was very easy. If you have all documents, never been out of status then you should be fine.
 
Reentry to US if visa is denied in canada with old valid visa

Hi GC_Lover,
I am on H1 visa and My US visa is valid until July2006 and I am planning to go to Canada for 7th year Stamping in May2006.My question to you is
"If for some reason my visa is denied in canada, would I be able to Reenter US with my old valid visa that is valid until July2006.I am very much confused about this..I would greatly appreciate your help in this matter..or anyone else whoever can answer this..

No, unfortunately you cannot. Once they deny your current stamping they will stamp cancel on all your previous visas so you won't be able to get into US.

Should I mention my 8th year extension petition details or wait on my 9th year extension petition details.

My advice would be to wait for 9th year petition details. I know those dates move very fast but I think you should wait for 9th year petition, that way atleast you won't have to worry about it later.
