9th year H1 extension after LC rejection

Hi,

My LC was applied from Delaware in my 5th year and it has been pending for long time in the regional office. I applied for H1 from other states in the 6th year.

I am in the 8th year of H1 now.

My lawyer is suspenting that LC applied from Delaware might be rejected because of the issues with my company. :(

In this scenario, will I be able to get 9th year extension if the LC from Delaware is rejected? :confused:

If I get LC from a different state or PERM in the mean time, will it be beneficial in getting 9th year H1 extension?

----- If LC is rejected you dont have any base for H1 extension.
if H1 extension filed while LC is still pending and H1 gets approved and later LC gets rejected then H1 extension is valid bot no more H1 extensions if you dont have any other base

----- what do you meant "If I get LC from a different state" ??? do you mean states are selling LC and you can get from any state? regarding PERM you need to discuss with your lawyer.
** better find approved LC that matches your education, exp at the time that LC was filed and file I-140 with LC substittion

Thank you for your response. I am sorry for a mistake in the original posting.

In the frist paragraph, I meant to say "I applied for LC from other states in the 6th year." My LC is in the process from Delaware and Chicago.

I am expecting Labour cleared from Chicago. Will this be benificial in any way to get 9th year extension?
