9th year Extension Possibility ????

Hi,

I am currently on 8th year H1-B extension which is valid until August 2007.

I was laid off from my Company A in august of this year with labor approved on feb, 2006 (was filed on Nov 1, 2001) and I-140 pending state.
Company B transferred my H1-B on August 10, 06 which is approved and got my extension which is valid until Aug, 07.
Company B is in process of filing PERM for me by end of this month.(Nov,06)
I now have 1-40 approved from Company A (approved on Sep 15,06)

What are my options/chances to get next year extension on H1-b?

There could be 3 situations i may in when time to file extension comes -

1) PERM pending
2) PERM approved and I-140 filed/pending
3) PERM and I-140 approved

Please advise in either of 3 situations, If i will or will not be able to get extension. If not, please let me if there is anyother option available for me.

PLEASE HELP. I need it.

Your chance is approval of PERM and I-140. PERM takes 3, 4 months including ad, and you now file I-140 under premium processing. The best case is you can reach I-140 approval in less than 4 or 5 months.
 
H1 Extension based on Labor Petitions filed after 6 Yrs

Dear Friends,

So let's assume COMPANY B files PERM Labor Petition & subsequently I-140 in premium processing and both are approved prior to I-129 expires (Aug-2007).

The situation now is that the benificiary has a approved I-140 but the accompanying labor petition was filed well after after the 6 year H1 limit.

Is this within the letter of the law from AC21 perspective to seek subsequent H1 extension for 3 years. In a nutshell, does a approved I-140 automatically entitle the benificiary to seek H1 extension regardless of when the underlying labor petition was filed?

I am pretty much in the same situation so keeping my fingers crossed....

Yes. There is no other condition assumed in the words regarding 3 year extension.
