90-day rule?

All,
I have a question: My Resident Since Date is Jun 04 2004. Technically, I am eligible to file N-400 on Jun 04 2009. However, I heard that you can start 90 days before Jun 04 2009 (around March 05).

So, is there an advantage for me to start now (before jun 04)? Will it make me get to the final destination faster? Or should I just wait until Jun 04 2009?

thanks much,
jasonb

The law is kind enough to allow you to submit your application 90 days before your 5 year green card anniversary. You should take advantage of that and file early unless you're not in a hurry to become a US citizen :) ..

Yes, you can apply now. The advantage of applying 90 days early is that you can get a head start on the process. Because by the time you have your interview you will be well into the 5 years required...

Good luck !!!

You have to give fingerprints and they have to run background checks, so even though you cannot actually become a citizen before the full 5 years there is still an advantage to applying early so those tasks can be completed sooner.

However, I would say it is not an advantage to apply exactly on the 90th day before the 5-year anniversary. If they miscount the days and think you applied too early, they can reject your application without an interview. It is better to wait an extra 2 or 3 days to avoid that kind of problem ... you're already about a week after that 90th day, so go ahead and apply now if you have all the paperwork ready.

90 days before June 4 is March 6. See how easy it is to miscount?

You can apply up to 90 days before you have met 5 years of continuous residence as a LPR. The advantage in applying earlier instead of on day of meeting continuous residence is that processing of your application starts sooner, thereby saving you some time.
