90 day - N400 application

I understand N400 can be submitted 90 day before.

My GC date is 05/05/2005. So, 5 yrs period would be complete on 05/05/2010

Based on 90 day rule, I am eligible to submit application after 02/05/2010. I am thinking of submiting the signed application on 02/06/2010.

Right...but to be safe, allow extra 7-10 days...as buffer to void any year to year counting differences...
 
I am very close to your GC date. I got mine on 04/15/2005....

I am very excited about filing N-400...

I am planning to send our application sometime on 01/25/2010..
 
You guys should look at average processing times at your DO. Be aware that USCIS is getting faster with processing these days. If you want to avoid "decision cannot be determined at this time" on your interview date, you may want to wait till say sometimes around 75 days before your 5 years anniversary or 3 years anniversary in case of marriage based. This will help you avoid non decision on your interview because if your interview happens before your 5/3 yrs anniversary, then for sure, you will get no decision but if you dont mind that, then you can go ahead and file around 90 days.

Either way, you have to make your own research and prepare for whatever happens because on the other hand, if you think your processing will be fast and then its a little slow then you will not like the advise I gave you to wait so be sure you are satisfied with the decision you are making but first if I were any of you, I will research my DO processing timeline average. Remember, that will only give you an idea but not a direct picture of how yours would be processed.

No need to rush. Things are moving very fast now.

I got GC in Mar 2003 and was eligible to apply in Jan 2008. Things use to take long time then, and I had business trips out of country at that time.

I applied in Sept this year and it seems to be pretty fast.

Wrong, you can apply on 02/04/2010 :D February has 28 days, not 29))

I regret applying early as my interview is 27 days earlier than my 5th anniversary.I believe if anything goes wrong you won't be protected by virtue of being PR for 5yrs.There is some kind of statue on this.I asked question in this forum what happens under those kind of circumstances and no body could answer satisfactorily.Therefore, I have schedule an appointment with Immigration lawyer next week. I have a long immigration history as I came to US in H-1 visa in 1994 later went to Canada and became Canadian Citizen and returned as PR of USA in 2004 december.Therefore folks who have 5 years history may not be in the same situation as I am in because I got my interview date within exactly 2 months from the date of my application.So use your judement.

Nope. Every 4 year period will have a leap year (except 2100 I guess), so this can be used for every app. If the OP got GC on 5/5/2005, then 4 years finish on 5/5/2009 (or 5/4/2009) and the next 1 year is when we need to check for the leap factor. The next February after May 5, 2009 is in 2010 and that is 28 days.

The OP got his GC in 2005, so he'll be eligible to apply 90 days before he has 5 years of continuous residency, which means Feb 2010. Since 2008 was a leap year, he would add a day to the calculation. The calculation isn't made by 4 year periods as you suggest.
