8 types of Security Checks ??? Your thoughts, please

I got stuck with Name Check for one and half years. In November, I recevied a letter from my senator office that my file is pending because of pending NC results from FBI.

I finally recevied a letter from FBI that they finalized my NC in December. In response to the inquiry, I then recevied a letter from USCIS stating that "The investigation into your background checks remain open".


My attorney's assistant spoke with the USCIS representative yesterday. They confirmed that my NC Is complete. They said that NC is one of the 8 checks they do. They will have to complete processing on all security checks to move forward.

I am confused. Is this a new process? Are you aware of this 8 types of security checks? Anyone else has recevied the same response from USCIS.

Please share your thoughts.

Name Check is just one part of the overall security checks that we have to go through. I am not aware of eight but I do know that there are background checks that are run on each applicant. In most cases Name Checks take the most time but any of these checks can take time. The problem is that there is very little visibility into this process and since it is attached to the much abused "National Security" issue there is very little we can do to speed things up. People have had success via Congressional inquiries and as a last resort people have sued the USCIS. The funniest thing is that most people who have sued the USCIS end up receiving their approval within a few days of the USCIS being notified of the lawsuit. This just goes to show that more than actual security checks (which are necessary), its the incompetency and apathy towards immigrants that leads to such delays.

I've heard of three security checks so far. Those are FBI fingerprints check, FBI name check and IBIS/ICE check.

In my experience on this forum....FBI namecheck is the only check...

I noticed USCIS bullshiting people like that...CIA Check...overseas check etc..but it's just bullshit and reasons for USCIS's either lost paperwork or sitting on it's ass to take it's own sweet time to adjudicate......


checkout this user, moody22...they had two namechecks on him...his first namecheck cleared 1 year back...and USCIS bullshited him until he filed WOM lawsuit...saying CIA check or something...

My advice - is - to go after USCIS....Keep inquiring through AILA/Senator/Congressman every month.....until they get off their asses and give you 485 approval...

Yep, the other two namechecks finish within 1 week...upon receipt of I485
 
I agree with saras on this. I would also like to add to what he said - To get you off their back,sometimes USCIS gives you load of b.s by saying your NC is not done yet, even though you know from FBI that yours is done. Also from my experience with USCIS,the vast majority of CSRs are ignorant,incompetent,lazy and arrogant and they confuse immigrants and play with their emotions. Also "parrot" is an appropriate word that can be used to mention these morons, reason being sometimes even after you humbly tell(prove) them that the info they are giving you is incorrect and thay themselves realising that,they don't want to relent,but rather they want to annoy and frustrate you by keep on repeating whatever they said earlier.

There is very little transparency and accountability in this whole immigration process,most of the time you have no other option, but to be a mute spectator to their indiscretions.......

I-485 filed in May, 2005
Name Check: Jun, 2005 --- December 15, 2006 (Got FBI mail).
PD: Current last September.
2nd FP: Oct, 2006

After I got FBI mail, I called CSC. The first time I was told NC is still pending(Sh.....it!!)

Second time, "Yes, we got your NC result..... Wait 30 days....."

Third Time, "Pending NC,....!!!". I told the guy that I got a mail from FBI, then she said "ok, we got it..... you need to wait for the visa ability....".
I said my PD is current months ago. She said "Ok, I will talk with other officers about your case after my work!!". Sh...it!!, she will definitly forget to do that.

Called 1-800 to place a inquiry. No result.

Ask my lawyer to send an inquiry today. Do not know whether he will do it.


The system is totally screwed up.
 
Thanks Saras, JMJ, Banta4GC, Kingroom and all for your responses. As you guys said that little/no visibility into this process is what killing us. After recevied a letter FBI, I thought the process from now on will be simpler, but it is getting wrose and worse

The good news you know NC is done. That's really good. Don't underestimate that fact. It means in theory you should get your approval soon. Just don't assume USCIS will do it for you so keep pressing them.

USCIS's system probably set an automated (as they like to say. I don't believe it) lock so you can make another inquiry only in 60 days.
Still try to call to USCIS again.
And ask lawyer to file an AILA request. (takes about five weeks but better than nothing).

8 checks? well, first they check that one paid his fees... second, they check that... I suspect it's a BS.

One step that I didn't understand is how you've got a confirmation on NC clearance from FBI?

My case was filed on June 20, 2006. And I called TSC, the lady said under "name check".

Writting to First Lady does not necessarily help you. I wrote to her and did get letter from FBI, but still the similar letter as I got from congressman's inquiry. PENDING... :mad:

FBI and CIA Name check

My FBI name check was approved 30-months ago and even though USCIS had assured me that all that was left on my I-485 was the FBI name check they are refusing to adjudicate my case citing ongoing investigations as the reason.

I can think of 2 reasons that a case would stall like this.

1) We should be aware that the FBI name check is not a pass or fail report. A completed FBI name check is simply a report of their findings. If USCIS deems that some aspect of the report warrants a further look then they will not process the application till they are done with their further investigation.

2) In addition to the FBI name check there is also a CIA name check that is almost never mentioned. If the CIA name check is not done then the case can not be processed.

While searching online I came across a copy of the official USCIS I-485 Checklist that needs to be completed to be sure that everything is in order. This is attached and you can see that the 3 security related items (in addition to the fingerprints) on this form are the IBIS check; the FBI name check; and the CIA name check. The same is true for N-400 applications.

Of course, in my particular case there can be no valid reason for taking 30-months (I filed the I-485 over 5 years ago) and I can preparing to file a Mandamus in federal court to seek redress.

Its amazing how much trouble some applicants have to go through. I am all for Security Checks but endless delays in the process are just not justifiable. Say a potential applicant is on the list and is upto something. If the FBI and CIA take 2 years to come up with a conclusion, does it not mean that this applicant has 2 years to do what he/she wants to do .. whats the point of such slow checks if the intention is "National Security". Shouldn't the process be quick so as to catch the bad guys promptly :). These security checks are mostly for show and CYA for the US government. The real criminals manage to dupe the system either way .. oh well.
