Brief History:
Got 7th year extension from company A in July 2005 valid till July 2006.
GC applied in Nov 2003.
Got fired in august 2005.
Immediately applied H1, moved to company B, got a 7th yr H1 approved
till May 2007, based on pending GC Labor from company A. I have started
new GC with my new company, but the process has just started, it is in
the advt. stage, still need to actually apply for the perm labour.

Now the question is:
I have a MX interview appointment on Feb 8th.
I have all the other papers. My question is what are my odds with success
at MX, considering that my Labor is pending (as of September 2005)
with my ex-company? Is it advisable to take this chance? What do I answer
if they ask me the about the fact that my pending Labor is from my ex
company? I really would like to go to India.

Please advice. Please help.
 
Stamping officer will not see these details at all.

He/she is interested onlu on Your h1 approvals, pay stubs (occasionally) status and company credentials.
Since your H1 petiotn is approved, they are not there to check LC papers. better you no need to mention anything about your LC.

one other question:
I was laid off Aug 15th from company A,
Next H1 with company B was applied Aug 23rd but approved September 25th.
I am missing paychecks for Aug31st and Sept 15th. I got compensation for
my accrued leave as a pay check for sep 30th, so i have this one.
Are they going to ask my paychecks just before leaving company A ?
I have paychecks for Oct, nov, dec, jan ... to date with company B ?

Is it true that we can take leave without pay ? so basically I can say that
I was on leave without pay and hence no paychecks for Aug15 to Sep 15,
if asked.

Please Help !!! :confused:
