Hello,
I have a substitute labor of 2002. My lawyer filed I-140 and I have a receipt for the same but not an approval since it was filed on July 5th 2007.
I will be completing 6 years in august. My H1B visa expires on August 1st 2007. Now my question is whether my stay is legal without filing for H1B. Can H1B be filed on the basis of RECEIPT of I-140 or an I-140 approval is necessary?
