7th Yr Extn On Exactly 365 Days Labor

Please reply to these 2 questions -
1. Iam completing 6th year H1B period on Aug 5 2005.
One more labor in Non-RIR is mailed recd date of Aug 4 2005 in NJ.
I think I have 365 days pending labor to apply for 7th yr extn.
When should I mail my 7th year extn applications. Can I do before Aug 4th itself.

2. In Feb 2005 I140 and 485 are filed on a Substituted labor. Got EAD's and Finger print done.
In May 2005 got an RFE saying that I-140 was an approved one.
My company agreed I-140 was an approved one but I485 was not filed on that by the prev employee
and that prev employee had given an affidavit saying that I485 was not filed and he got GC through his Wife.
The lawyer replied RFE saying the same thing with Affidavit and a letter saying that they can use this labor for me.
I came to know that the lawyer should have withdrawn the approved I140 before submitting my 140 and 485 applications.
The lawyer screwed up the case I think..
I am waiting for the reply.
What is going to happen now.

My 6 yr H1 IS getting over by 25th sep 05
I applied for GC on 23rd Sep 04 ( 1 yr and 3 days)

Can i APPLY FOR my extension now (new may 12 yates memo) or have to wait till i complete my 1 yr of filling i.e. by 23rd Sep?
