7th yr extn based on a subsitute labor from future employer

Hi,

My 6th yr ends, before the LC (with current employer) completes its 365 days. In order to mantain the legal status, I am requesting the company attorny to apply for 7th yr extn based on a pr-approved labor that has been used for my I-140 application with a different company (future employment).

From the discussion forum, I learnt that this is a possible case. But, surprisingly, hte company attorney is saying that they can not apply 7th yr extn based on a pre-approved labor from different company.

so, is it really not possible for the extn ??.

If your 140 is pending then you can automatically apply for the 7th year extension. Ask you attorney and tell him that your 140 is pending and that alone is the basisi for the 7th year extension.

And also the immigration proceedings (labor, etc.) must have being filed 365 days before the expiry of 6 yrs.
