7th Year Possible?

Hello Gurus,
My friend applied for his labor in sept'04 and his H1 6 years gets completed on Aug 5, 05. His labor was approved couple months back but since priority dates are not current he can not get EAD. What is the possibility of getting H1 extended to 7th year?

If labor is approved he can apply I 140, during the time he can extn 7th yr. If I 140 already approved also he can extend H1 for the 7th year.

Lawyer saying no

Thanks for reply. He asked lawyer to file for the extension based on approved labor and 140 applied but lawyer is saying it is not possible if 365 days have not passed since filing of labor.

better ask a knowledgable lawyer. It is possible.
