7th year H1B Extension

Hello Friends,
My six year term on H1B1 ended on the first week of january,2004 but i got my visa (both h1b and visa ) till jun, 2005. I have applied for I140/I485/EAD on the first week of jan, 2004. Shall i need 7th year H1B extension ? if so, what is the procedure to apply for the same. Your reply is greatly appreciated.

How do you say that your H1b ended on first week of January 2004? H1B 6 years are counted from the day you entered US first time on H1B.

---- If you have H1 approval till Jun 2005 you are on H1 till that date or till your I-94 expiry date, what is the I-94 expiry date?

------ IF your H1 approval notice or I-94 are valid till Jun 2005 you are on H1 status at this time and you will be eligible to file 7th year H1 extension before your I-94 expires and you need to file 7th year H1 with I-140 pending or I-485 pending receipt

** you seem to be confused or providing wrong info at one point you say H1 expired and at the same time you say your H1 is valid till 2005, you should post full details when you first entered US on H1 and when was your H1 extensions filed, what date your I-94 expire , till what date you have H1 Visa stamp in the passport. did you change employers or filed for H1 transfers or H1 extension? did you got new I-94 attached with your recent H1 approval notice if yes then what is the latest I-94 expiry date

Thanks for your reply. let me give the detailed info.

First Entered into USA : 6th of Jan, 1998
After that i have filed for H1B transfer three times. (1999,2001,2002)

The last H1B transfer is valid till Jun, 2005 (from oct 2002) and I 94 too till that date.

Now my question is , whether i have to file for 7th year h1b extension even though they have given my h1b and i94 till jun, 2005 (beyond six years).

----- I don’t think you need to apply H1 extension for 7th year as you have valid H1 and valid I-94 till 2005 but you are eligible to file 7th year H1

If you feel that your H1 was approved beyond 6 years then you should file 7th year H1, count the days from first entry to US. Sometime USCIS makes a mistake, go to your lawyer with your passport and all H1 approval notices and explain him if you need 7th year H1 extension
