7th year H1 ext approved

Do you mean that your I-485 is pending, but you got approved for H-1 extension? I thought the 7th year H-1 only applies to people in labor certificate phase.
Would you please give some detail about your case?
Thank you and congratulations!

zhennl,
7th year H1 ext can be applied for any H1 holder if their GC process has started and at least one application is pending for the approval. Let it be LC or 140 or 485. It is individuals choice whether to use EAD or continue on H1. I am working with the same company for the last 6 years. My company and attorney decied to extend H1 instead of working on EAD.

>When it comes to H1B extension is it expensive
No it is not...
H1 like I-140 is the company's petition, so you could have the company's HR file it for you without employing the services of a lawyer. The filing fees is $130 which is far less than what it used to be earlier when a $1000 fees was charged during the days when the H1B quota used to be 195K.

al_paso is correct. My employing company spent only $130 filing fee and filed it by themselves. What actually we did was, we filled in the H4 forms and mailed it to our company. While filing H1, they just enclosed H4 with H1 and mailed all of them together.

peace_of_mind,

I have EAD and valid H1. I have not used EAD. I am still on H1. My wife who has EAD and H4. but she worked using EAD. Can I apply to renew my H1 and H4 for the 7th year?

Peace_of_mind and al_paso:

Would you guys elaborate the procedure of 7th Year H1B extention a little bit more. I am tired of paying the "blood sucking" socalled attorneys who only fill the application and charge money.

I want to apply for the extentions myself. What are the papers I need to enclose. How can I get the LCA.

Thanks in advance.

First H1 holder is the primary applicant. Since you have not used your EAD, you are elligible for H1 extension. You can travel using H1 or AP which ever is convienient to you.
Since your spouse has used EAD, she has accepted AOS. H4 is no more valid. Since H4 is no more valid there is no question of applying H4 ext too. For travel purpose she has to use AP.
If you have a child dependent..., his/her H4 is still valid as long as you maintain your H1 status.
You being the primary applicant, if you use EAD, then all your dependents too would be in AOS, for travel purpose every one of you should use AP.

For H1 extension only your sponsoring employing company has to apply I-129. Filing fee for I-129 is just $130 + mailing charges. Any person who is performing HR duties can fill in the form and attach the required documents. First time filers may have numerous question but not at the time of applying extension.
Unless your company is cheating you, you do not need to pay even single penny for H1. Also remember, companies charging the employee for H1 is illegal, ofcourse this is very common from consulting companies.

Peace_of_mind:

Thank you for your reply. Actually my company has no clue how to apply for extention. They are honest and I am the only H1 employee. So they are asking me to apply and will supply necessary papers if needed. I am tired of making this attorneys rich. But I am a layman in this field.
