7th year H1-B extension

Hi All,

My 6th year H1-B term is expiring on Feb 1, 2005. At present, I am working with A company and they have filed my LC in June 2003 with NJ under RIR category. NJ Labor is currently processing March 2002 RIR cases.

If my present company A lays me off, can another company B file for my 7th year extension assuming that company A does not revoke my LC application? If yes, what documents I may need from company A, so that company B can file my 7th year H1? If not, is there any other way to continue my stay here legally in US?

I will appreciate inputs from my senior members.

----- try to get LC filing reciept from your lawyer that filed LC wiith SESA or SWA Trenton NJ, that reciept is the only evidence that LC was filed , if lawyer has not recieved the reciept he can call up, write NJ SWA or SESA and can get the reciept in 1-2 weeks

---YES company B can file the 7th year H1 if you have evidence of LC pending more than 365 days and not revoked and you have evidence.

What evidence you need to provide that the LC has not been revoked and still it is pending with Labor department? Do you mean that company B will need to submit a letter from NJ SESA or SWA stating that the LC filed by Company A is pending with them and LC was filed on such and such date?
 
Can I get H1-B visa 7th yr extension?

My H1 6 yrs will be exhausted in Jan 2005. I got LC approved in Jan 2004 and applied for I-140/I-485 in March 2004. Received EAD/AP/FP.

Given following conditions, can I apply for H1 7th yr extension as I don't want to be on AOS status (to be on safer side).
1. I have not used EAD/AP.
2. My I-140/I-485 are pending.
3. If I can get H1 7th yr ext, what happens if I-140/I-485 get denied (god forbid!!)?

---no such letter from B is needed just attach LC filing reciept, for more info go to your lawyer,
simple thing just to get LC filing reciept, you are not understnding and repeating the same. first get the LC filing reciept then post
