URGENT#7th year extention with ex-employer labour & I140

I'm looking for the possiablty of 7th year extention.

Here is my case:

My labour and I-140 are cleared from company A. The
company went backrupt and I got layedoff back in
2000. Now the current employer (company B) is
not doing green card. My 6 years of H1B is going
to end in May, 2004.

If I join another company (say C) willing to do
H1B, can the company C apply for the 7th year H1B
extention based on the approved labour and I140
of company A.

As far as I know ...... you can apply for 7th year extension for company A based on company B approved 140 if still its valid.

I was also in same boat.. mean while i got lc cleared from another state.

---- YES, you can apply for 7 year H1 extension based on any employer LC filing 365 days back or I-140 approved and I-485 filed and pending pending or I-140 pending.
--You need the evidence that your LC was filed 365 days back or more than that, you need the SESA receipt that has your PD for LC, you can ask for this from your past employer or lawyer. You did a mistake if I-140 was approved you could have filed I-485 that way you could have used AC21 (if I-140 is not revoked by the past company)


LC is always valid once approved but employer can use LC for other employee if other employee meets the requirements at the date LC was filed. I-140 can be revoked by employer and I dont think he would have revoked If you have I-140 approved copy or I-140 filing reciept then check the BCIS Online status with your Reciept #

Do you have any concrete details for this (i.e extending H1 based on previous company's I140? I am in the same boat. Problem is that my company lawyer does not agree and I need to provide some definite proof. Any ideas?

Received 7th Year Extension from Previous Company's LC

Just wanted to let you all know, that I just received my 7th year H1 based on the previous employer's LC which was filed 365 days before the 06 year expiry.

The current employer's LC was not at all used, even though it was files 358 days earlier.! :)
