7th Year Extension?

Hello Everybody,
I am one of the millions who filed for 140/485 in EB3 at Dec 31st, 2004 deadline to beat the retrogression. My 140 is approved and have already got the EAD/AP. Same with my wife. She is using her EAD to do some work. I am still with H1 employer and probably will remain with him for forseeable future.
My 6yrs are getting over on August 8th. I called my attorney and asked him if I need to get the H1 extension. He said it is okay to work on EAD but he would really prefer for me to have H1. He said I can get the 3yrs extension in one attempt.
My dilemma is do I need to have H1? It is going to cost freakin $2000 again. I have already spent so much money on immigration in last six years that I would have probably never saved in my life time of working in India. Regardless, that is not the only issue. How does it effect my wife's situation? that is my main point.

Any one in similar boat or with any opinions? I would really appreciate to hear from you.

If you would like continue on H1 you will get three years extension. No problem with your wife. In case of certain problem keeping H1 helps a lot.
 
Her Status?

Thanks for reply. Out of curiosity, what will be her status if I am on H1 and she is working on EAD?
 
Stay in H1B status until get 485 approval

Hi,
I have the same situation now. Mine also going to over on september. I also filed I-140/485 on last december 2004. I got approved 140, EAD and AP.

My wife also going to use her EAD for work. I talked with my attorny.
She is prefering to stay in H1B status until I get my green card. She is asking to file H-4 also for my wife.

Otherwise, In some case 485 rejected both will be in out of status.
So. Please don't see the money to file. You already spent lot of money. If you spend money for this, Your whole process will be successfull. If you don't spent money for this filing, you can't give any assurance.

Please file H1B and H4 extension for you and your wife. I am going to file tomorrow for both of us.

please verify

Is it true that you get H1 extension valid for 3 yrs even after your 6 year limit .(assuming ofcourse your 485 is pending) I thought they give validity only for one year.

If you show the I-140 approval they will give 3 years extension for H1B after 6th year.
