My H1B(6th year) is expiring on Jan 2005. My I-140,I-485,EAD and AP were concurrently filed using a pre-approved labor(Labor Substitute). Now since my 1-140 was approved on 08/02/2004 am I eligible for 7 th year H1B extension ?
Yes I can just use my EAD, but I think its safer to hold on to your H1 status till I-485 is approved.

My attorney said that it is safe to be on H1 status until I-140 is approved. After that, she thinks it is better to switch to EAD since it is cheaper to renew (ofcourse, it does not matter if your company is paying for it, like mine)
I am in the same boat as you. My H1B(6 years) will be expired in march2005. My I-140 has been approved 3 months ago and I-485 has been pending for 1 year. I have just got my 2EAD. So wondering if it's better to use EAD or extend the H1B(7 years) since my company is not going to pay for H1B. However, it's really kind of wasting money by renewing H1B(7years) which will just be valid for only one year.
If there is time left to complete six year:
If you still have time left on your H1-B (i.e. to complete six years) then it's a good idea to get H1-B extended even if you have EAD/AP. Just in case anthing goes wrong with I-485.
Once six years are over:
If you have valid EAD/AP then it's doens't make sense to get 7th year extension. Exception: You are single and planning to marry someone abroad.
