HI All,

My 6th year H1 expires in Dec 2004.

I have filed my Labor in 2002 which got approved in June 2004. I have filed my 140/485 concurrently in July 2004.

I would like to file for my 7th year extension. Would i be eligible, as i read somewhere that for filing for 7th year H1-B extn we need to have I-140 pending for more than 365 days. Please advice what my best options would be.

Yes you can

you can apply for 7th year based on your priority date(Labor filing date). Since ur priority date is > 365 , you are eligibile for 7th year extension.

Just my view, talk to your lawyer.

You are eligible for 7th year extension.

The "current" interpretation by USCIS is that if your case is pending either at labor or at I-140 stage, you are eligible for the extension.

8 th year extension

Is it possible to take 7th or 8th extension after I-140 has been approved?
