My 6th year period is ending on 6 June 2004; I have applied LC on 4 June 2003. I have only 2 days window. On this situation my questions are
1. Will I get my 7th extension without any problem
------ If your LC was received by SESA or SWA you need the receipt from SESA or SWA that receipt has PD or the date when they received LC, lawyer who filed LC he gets that receipt from SESA or SWA check the receipt if SESA received your LC on June4 2004 then you will complete 365 days June 4 2004, if you have evidence that LC was filed 365 days back then I don’t see any problem for 7th year H1 extension. FYI many lawyers say that they have filed LC on XYZ date but they send late, the date SESA or SWA receives LC is the date when 365 days start not the sending date and 7th year H1 should be filed or reach USCIS before I-94 expiry date (FYI, 2004 is Leap year February will have 29 days not 28 days)
2. When I have to apply for the 7th year extension.
----- You can apply 7th year when you hit 365 days
3. What are the documents need to do the extension.
Form I-129, LCA + evidence that LC pending more than 365 days (SESA or SWA receipt copy is the evidence)
4. My wife has to be here ,as she has gone to India.
----- if at that time she is in US file her H4 extension with your 7th H1 extension papers, if she is out of US then she needs your 7th year H1 approval notice to get H4 visa stamp from US consulate in India, FYI US consulates are creating many problems for visa stamping .
