7th year extension with old Labor

I have my 6 years H-1 till Dec 2006. My labor is pending for over 2 years with current employer. If I shift to a new company and my new labor with new company is applied like in March 2006, can I apply for 7th year extension at new employer showing old Labor filing at old employer? Also lets assume the old employer don't continue process once I leave.

You can get 7th year extn. based on old employer LC, provided they do not withdraw the LC petition. If they withdraw the LC , then you do not have any pending LC more than 365 days to qulaify 7th year extn.
