7th year Extension to get a H4

My lawyer who agreed initially to apply for 7th year extension, now tells me that I am not eligible,
since I got my EAD now and my 6 year H1B expired on June 24. Is there any way I can get a
7th year extension, so I get an H4 for my wife in India. any input appreciated

I did not get the Extension, but got my EAD and its moving fast.
Looks like the only solution is for me to try to get her a
F1 or H1-B or apply for "follow-to-join" so she gets greencard in India.

Hi Raja/Ram Bala/Anyone who has some info,

I got my I-140 approved. My H1B 6 Yr prd is ending in March 2002. Applied for 7th H1B extension based on I-140 Pending... With in 2 months my I-140 got cleared. I know that I am going to get RFE for my H1B filing. My questions to you are

1. Can I bring my spouse on H4 based on my 7th Yr H1B?
2. How safe it is to travel with 7th Yr H1B? I saw lot of articles saying "ONLY stay is extended not VISA, So you can\'t get it stamped" Also they say, you have to revalidate your 7th Yr H1B visa with Department of State(DOS) before traveling.
Does any one give me a clear picture of what all these lines mean?

I appreciate your input on full/part of the above questions.

1. Yes, your spouse can get his/her H4 visa with your 7th year extension. Make sure he/she brings along a copy of your I-140 approval notice in case they ask.

2. I don\'t know what they meant by "only stay is extended not Visa, so you can\'t get it stamped". It doesn\'t sound right. Revalidating with DOS before traveling simply means getting a new visa stamp with the valid dates on your new extension, whether it\'s a 7th year extension or not. The advantage of this is that you don\'t need to leave US at all to have that new stamp.

We had no problem obtaining the H1B/H4 visa for 7th year extension in October (in Canada). We were asked a few standard questions, asked about the I-140 approval/receipt and that was it. We have travelled between US and Canada several times since October with no problem.

Actually I voiced what I had learnt from this web-site. Since you have have first hand experience, I will take it at it is.

As soon as I get my H1B for 7th Year, I will go to canada (Toronto) to get it it stamped.

I am wondering whether we can take an appointment before going there?
I will take the following docs along with me.
1. Passport
2. New 7th Yr H1B visa
3. A copy of I-140 approval notice
4. A copy of receipt of I-485 filing if available (by then)

Is anything else is required, like experience letter from my employer stating I have permanent job bla bla bla?

Letters, most recent pay stubs, etc.

We got our visas from US consulate in Toronto. You can reserve an appointment through www.nvars.com. The slots fill up rather quickly, but I had found in the past if you try early in the morning, there may be newly vacated time slots due to cancellations.

Once you made the appointment, they will send you a package containing your appointment letter, instructions on what to bring, and application form. It will be best if you reserve 2 to 3 weeks in advance, allowing ample time to receive the package in mail.

Please be aware that you will be subject to a 20-day wait if you are male, age between 16-45, and from one of the 20+ red-flagged islamic countries. Hopefully you don\'t meet the criteria here.
