7th year extension question

Hi,

Here is my situation. Please help if you can.
My 6 yrs on H1 are completing on Nov 2004. I've applied for GC labor in Mar 2003 via NY (which is ver slow).
Now I'll apply for 7th year extension (and if premium i can get it within 15-20 days.. I hope).

my question is do i need to apply in premium processing ??
I saw that the Vermont center is processing cases from Aug 2004.. does that means the extension will come in 1-2 months ?? or is it just that the service center has started working on the cases from Aug 2004 but will take couple of months in processing it ?

---- It is USCIS time for H1 extension may be fast or delayed nobody can tell you how much time they will be taking after you file
or is it just that the service center has started working on the cases from Aug 2004 but will take couple of months in processing it ?

Hi Vikas,
As soon as you file for your 7th year extension, you get six months extension, so you do not have to HAVE the 7th year extension before your end of 6 yrs.

Also, you are right that they are doing extensions for cases filed in Aug;04 right now. They have picked up lately, as a friend of mine filed in early July and got his extension by end of August.

But, then again you never know with these guys. Unless you have travel plans and need the 7th year extension, I think you can file under regular process and go from there.

I belive it is a 240 day exension. And you do not need to have teh approval before the end of 6 yrs.

thanks you very much guys for your time and advice!

Actually I am thinking of using this H1 (the extended one) to switch to a company B with an approved labor OR a company C processing GC from a faster state (New Hampshire)... depends whichever works out!

so if I get my extended H1 in 15-20 days.. I can apply for H1 transfer based on that... to company B or C.

just one more question....

is it possible for a company B or C to apply for H1 transfer and at the same time apply for the 7th year extension based on a pending labor??
