Hi guru,

my 6 year will complete before 365 days of labor filing. however, I had labor filed from previous company about 2.5 years back which never got approved. last year I had to leave the company and do not know the status of filed labor.

Now that when I can not file H1 extension based on my current labor, can I file 7th year extension based on that previous labor filed? please advise.

Thanks

----- if that LC is still pending and you have the evidence that LC was filed for you ( evidence is SWA or SESA reciept that they send to lawyer who filed LC after the SESA or SWA recieves the LC) then you can file 7th year H1 extension, if that LC is approved and if you have good relations with employer then he can file I-140 for you and you can file I-485, EAD AP before your H1 gets expire.

can I file 7th year extension based on that previous labor filed?
----yes, if you have SWAor SESA LC filing reciept copy that states the reciept date, Case# employer name and your name on it
please advise.

Thanks
