Hi there, my 751 was "denied for cause". I called the 800 number and the officer told me my 751 was denied for cause 40 days ago. Probably further documentation was needed and I failed to send them in. I did not receive such a request and I was in Europe for the last 7 months. I should have received the denial letter also, which again I did not receive. Most likely I will be given a court date in front of an immigration judge within the next weeks.
Here my Questions:
1. What will happen if I leave to Europe before the hearing is scheduled? Will I be able to enter the US as a tourist again?
2. In the event I cancel my flight to Europe will I be deported immediately after the hearing or is it 100% certain that I will be given ample time to prepare for my travel (outside the detention center)? I overstayed my visa in 2003 for a few months!
Thank you for your help :-)

You may be unable to reenter the US.
Will I be able to enter the US as a tourist again?
No, because you obviously have demonstrated immigrant intent.

Can't predict that. They may initiate removal proceedings immediately, or they may initiate it months later. Once the proceedings are completed, they may deport you immediately, or hold you in detention for months and then deport you, or grant you voluntary departure with a deadline to leave on your own by a specified date. Or with a good lawyer you may be able to overturn the denial and get your 10-year green card.

thank you for your kind answers. What will happen if I am not in the US during the hearing? Will I be able to participate via phone? I want take the risk to be put in detention center after the hearing. I read to many unpleasant stories?

I-751 denied

I don't want to spend another few thousands with a lawyer, nor do I want to fefile I-751, nor do I want to appeal. Either the judge sees that it was not my mistake or I move back to Europe. My wife is also very annoyed. The only big drawback would be that I probably cannot enter the US within the next ten years. I have to go to Germany for business in two weeks and I don't want to let that deal go, just to wait for a hearing without even having a date for the hearing.
Sorry, that I sound so frustrated. Is there any form I can file to reenter the US for the hearing? Thank you
