7 th year extension - Help

My 6 yrs duration on H1 visa expires on 03/05/2004 .I have Labor certification Filed on 02/24/2003 and is pending.

The new memo for H1 Extension states that application for 7th year xtension has to be filed after 365 days of filing of labor
certification ,that will take me to wait till 02/24/2004 before I can file for 7 year extension and I will have only 8 days left for my 6 year H1 limit expiry .

Can I stay in US while my 7 th year extension is filed and is not approved yet .. ?

Can 7 th year extension be filed before 365 days of filing labor ?

The 7th year H1 extension can be filed only after 365 days have passed after applying for LC. You can stay in US while the 7th year extension is pending. But you will need the receipt notice to continue to work beyond 3/5/2004.
