I am currently on my 6th year of my H1 B visa, which wil expire next March. My employer and I spoke with an attorney a year ago about the green card process and LCA. Based on the fact that I did not have a technical degree but my job was technical (web development), the attorney said that the chances were not too good that the Labor department would approve my LCA, especially with the unemployment rates being so high. At the time, I decided to save the 4.5 k and not go through with the application since there was a good chance I would just waste the money for nothing.
Since then I have received a technical Masters' degree. I am wondering if I should even try to look for a job here now, and if I do find an employer willing to hire me with immediate processing of the green card along with the H1 B transfer, would it make a difference at all? I have been told that I need to have at least one year in order to have the LCA done so that I can extend the H1B to 7 years.
I would appreciate any thoughts/advice.
