6yr. H-1 Expiring on December 2007 but got new job offer!!

Hi,

My 6 yr. H-1 will be expiring on Dec.2007. I have filed for LC 4 yrs back and still waiting for it, because of my lawyer. Now, I got a job offer from another company and they are ready to do anything to have me. Should I take the new job now and forget about my LC from my current employer? Can I apply for perm if I join the new employer and get my H-1 extended for 7 yrs.? Does anyone can help me with a good immigration lawyer's contact number? I have a great job offer, but worried about the fall back of my decesition.

You need to be clear with your information. after 6 th year H1 you can file for extension if you have LC pending for more than a year. you said your LC was pending for 4 years this would mean you filed LC before 3 years of your first H-1 was completed . and that may explain how second H-1 was approved. 7th year extension is given if you have LC pending for at least 1 year longer this is even better.The only other way to get 7th year extension is if you have an approved I-140.

Thank you for your reply. Yes, you are rite. If I stay in my current job then I will get my 7 yrs extension. What are my options if I change my job now? Will my H-1 be given till December when it will expire? My new employer is willing to do the perm for me. If my perm does not get appprove by December, what will be my options? Should I change my job or stick with my old one?

I'm pretty much in the same situation my 6th year is expiring on November. I got a job offer from another company who is ready to file a perm LC. Will the new employer be able to transfer my H1 and how long would my extension be valid for.

Hi

I am in the state of bonded labor. Someone guide me please.

My Status:

1. My LC and I-140 have come through.
2. I have 1 year left for completing 6 years in USA on H1B.
3. I know my employer will renew my visa provided I have a client to work for.
4. I have my application on EB3 with PD of Nov. 2002.

Problem:
I have to change my Job. I do know that I can find one. In past, I have been finding work on my own.

If I change my job, Will I get HB1 renewal beyond 6 years? Will my current LC and I140 benefit me in any way?

My employer is not going to assist in anyways. His business model is such to limit employee’s options. He does not even respond to my phone calls and I do not get response to queries also. I am in a mess and nearly on the verge of going back in spite of having a great client right now.

Any suggestions? Should I wait for EAD + 6 months (PD has been stuck on 8th May 2001 for that past 6 months)? Should I change job?

I have taken a lot of nonsense from my employer in the hope for a GC. I see all my sacrifices go waste as my employer is tightening his noose around my neck day by day.

Do I have any legal standing against my employer in USA?
