6th year on H1B, extension with no LCA filed

Hello all,

I have a quick question. Here's the details:

- My wife applied for I140 EB2 a year ago and we're still waiting on that.
- I have 6 months on left on my H1B visa (6th year)
- I have no LCA submitted and I don't have a GC application (thru my employer)

Is there anything I can do to apply for/get an H1B extension at this moment? Or is it too late? I kind of relied on my wife's application and I regret doing it.

Thanks

Hello all,

------------------Your Wife I-140 has nothing to do with your H1 Extension.
- I have 6 months on left on my H1B visa (6th year)
- I have no LCA submitted and I don't have a GC application (thru my employer)
----- LCA is for H1 and LC is first step for GC. if No LC is filed for you then you will not get H1 extension.
Is there anything I can do to apply for/get an H1B extension at this moment? Or is it too late?
----- too late but still ask your employer to file LC ASAP
I kind of relied on my wife's application and I regret doing it.

Thanks
FYI if you have spent the days out of US and have record of days spent out of US then good lawyer can apply extension and can recapture the days spent out of US.
