6 years over, left the country. What about the new law??

Hi,

I completed my 6 years on H-1B and I left the country to Canada(holding Canada PR) in Jun 2002.

When I left the country, my labor application didn't get approved eventhough it waited for more than 365 days.

But when I heard about this new new law, Can I file for 7th year extension, after President signs this law?

Do I have any chance??

What's the heck just wait for few more months, get the H-1B for 6 years more???? (From June 2003)

New Law:
"It is likely that a new law will be signed by the President within 10 days permitting H-1 extension beyond 6 years for those people who are still in labor certification stage and their applications have been pending for a year or more. The current law allows this benefit only to folks who are at
I-140 stage. The new law will provide relief to many."

The new bill states that all those who left the country (or are not on H! anymore) will also get benefitted by it. So it seems you might fit into that category. Check with your attorney and (s)he might be able to tell you.

BTW, are you ex-NIITian (b'coz I am and I know someone with name GRajan so got curious)?
